Terms of Service

These Terms of Service govern your use of RemembranceHub, operated by Oleksandr Tepliuk, sole trader based in Ukraine. Please read these Terms of Service (“Terms”, “Agreement”) carefully before using RemembranceHub and any related features, applications, or services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must stop using the Service immediately.

1. Overview

RemembranceHub (“we”, “us”, “our”) provides a digital platform that enables users to:

  • create and manage memorial pages
  • upload photos and personal content
  • generate AI-processed images
  • manage family data
  • purchase digital products such as AI credits or memorial packages
  • optionally use tools intended for funeral businesses or service providers

All services offered are fully digital. No physical goods are sold through RemembranceHub.

2. Eligibility

You may use the Service only if:

  • you are at least 13 years old (or the minimum age required in your jurisdiction), and
  • you have the legal capacity to enter into binding agreements.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. User Accounts

To access certain features, you must create an account and provide accurate, complete information. You are responsible for:

  • maintaining the confidentiality of your login credentials
  • all activity under your account
  • updating your information when necessary

We reserve the right to suspend or terminate accounts for violations of these Terms.

4. User-Generated Content (“Inputs”)

You may upload photos, text, stories, and other materials (“Inputs”), including content related to deceased individuals.

By uploading Inputs, you represent and warrant that you:

  • own the rights to the content, or
  • have permission to upload it.

You are solely responsible for your Inputs and for ensuring they do not violate any laws or rights of others. We do not claim ownership of your Inputs.

5. AI-Generated Content (“Outputs”)

When you use AI tools in the Service, you may create generated images or text (“Outputs”).

Unless stated otherwise:

  • You own the rights to the Outputs you create.
  • You may use them for personal or commercial purposes.
  • Usage remains subject to the rights of any third parties referenced in the Inputs.

We may store Inputs and Outputs to improve our service quality, ensure safety, and comply with legal obligations.

6. License to Use the Service

We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You may not:

  • reverse engineer or attempt to extract source code
  • use the Service to harm others
  • upload unlawful, abusive, violent, or infringing content
  • interfere with or disrupt the Service

7. Prohibited Activities

You agree NOT to use the Service to:

  • violate any law or regulation
  • infringe copyright or privacy rights
  • impersonate others
  • upload illegal or harmful material
  • exploit minors or vulnerable persons
  • spam, scrape, or overload our systems
  • conduct fraud, including payment fraud

Violations may result in immediate account termination.

8. Payments, Subscriptions, and Digital Products

Payments are processed by third-party providers (such as Paddle). By making a purchase, you agree to their terms as well.

Digital Products

All purchases (AI credits, memorial packages, etc.) are digital, non-transferable, and non-refundable, except where required by law or explicitly stated in our Refund Policy.

Subscriptions

  • billing occurs automatically at each interval
  • you can cancel anytime
  • cancellation prevents future charges but does not refund past payments

You must keep your payment information up to date.

9. Website Verification and Third-Party Services

To operate the Service, we rely on third-party providers, including:

  • Paddle – payment processing
  • AI model providers – image generation
  • Hosting services
  • Analytics and security services

These providers may process your data according to their own terms and privacy policies.

10. Intellectual Property

All trademarks, logos, and branding associated with RemembranceHub belong to us. We retain ownership of:

  • the platform
  • website design
  • software code
  • features
  • original graphics and branding

Users retain ownership of their Inputs and Outputs, as stated above.

11. DMCA / Copyright Policy

If you believe your copyright or trademark has been violated by content on RemembranceHub, send a detailed notice to:

remembrancehub@gmail.com

Include:

  • your contact information
  • description of the infringement
  • link(s) to the content
  • a statement under penalty of perjury that your claim is accurate

We respond to valid DMCA and international copyright requests.

12. Termination

We may suspend or terminate access to the Service:

  • for violations of these Terms
  • for abusive or harmful behavior
  • if necessary to protect our users or platform

Upon termination, your license to use the Service ends, and we may retain certain data as required by law or our Privacy Policy. You may delete your account at any time.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. Use of the Service is at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, RemembranceHub shall NOT be liable for indirect, incidental, punitive, or consequential damages, loss of data, profits, reputation, or goodwill, issues arising from third-party services, or unauthorized access to your account. Our total liability for any claim shall not exceed the amount paid by you in the last 12 months.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of California, USA, excluding conflict-of-law principles. Any disputes shall be resolved through binding arbitration in San Francisco County, California, unless prohibited by applicable law. You agree to waive participation in class-action lawsuits.

16. Changes to These Terms

We may modify these Terms at any time. Updates will be posted on this page with an updated effective date.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
